Today, we see that more and more public sector organizations are buying through so-called framework agreements. Stay with us. We launch another term in the mix, but it`s relevant, promised. Indeed, from a public procurement perspective, an executive is a list of pre-qualified suppliers who can apply for work around a certain group of goods, services or works – because they have all signed the framework agreement. Buyers then assign individual orders (call-offs) for the duration of the frame. So, to have a chance to sell to the public sector, you should first be listed in a framework. But to actually work with a buyer, you need to move on to the appeal phase. How to actually get to the call phase is a whole other cauldron fish that we won`t be dealing with on this blog. Undertakings, in particular contracting authorities, may conclude framework agreements with one or more suppliers which impose the conditions that would apply to any subsequent contract and provide for the selection and appointment of a contractor with direct reference to the agreed conditions or to the implementation of a selection procedure in which only the partners in the framework agreement are invited to submit specific commercial proposals.  For many cases, it is useful for UNHCR to sign a long-term contract with a supplier, whether for goods or services. These are known as “framework contracts” and we have signed them with a large number of companies for items used daily by UNHCR staff, including vehicles, radios, telecommunications equipment, generators and office equipment, and for assistance with tents, blankets, isomates and kitchen kits. In the context of negotiations, a framework agreement is a framework agreement between two parties, which recognizes that the parties have not reached a final agreement on all relevant issues concerning the relationship between them, but have agreed on sufficient issues to continue the relationship, while providing more details in the future. These fixed-term contracts (usually 3 to 5 years) are usually concluded following an open international call for tenders. They ensure that UNHCR can quickly place orders for its needs at fixed prices, but do not guarantee that the Agency will purchase a minimum or maximum quantity of goods during the term of the agreement. UNHCR`s framework contracts are not exclusive. In the context of procurement, a framework agreement is an agreement between one or more undertakings or organisations `the purpose of which is to define the conditions applicable to contracts to be awarded during a given period, in particular as regards the price and, where appropriate, the quantity provided`.  Each party represents and warrants to any other party that the performance, delivery and implementation of this amendment has been approved by all necessary capital measures of that party and is not contrary to that party`s articles or statutes; and (b) that Party fully complies with all agreements and arrangements contained in the Framework Agreement as amended.
